1. Acceptance of Terms
By accessing or using the Homier platform and services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and Homier, LLC, a Delaware limited liability company ("Homier," "Company," "we," "us," or "our") governing your use of the Service.
2. Description of Service
Homier provides software tools for managing private vacation home sharing among trusted individuals. We are a coordination and calendar management platform, not a marketplace or booking agent.
Our Service facilitates coordination between property owners and their invited guests by providing:
- Private property listing and management tools
- Invitation-only access control systems
- Calendar and booking coordination features
- Communication tools between known parties
- Optional SMS notifications for booking activity (requires phone verification and explicit consent)
Important: Homier is a neutral software provider. We do not vet guests, supervise visits, provide insurance coverage, or intervene in disputes. We are not a party to any agreements between property owners and guests. All arrangements, responsibilities, and agreements are handled directly between users.
3. User Accounts and Eligibility
3.1 Age Requirement
You must be at least 18 years old to use the Service. By creating an account or using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.
3.2 Account Creation
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Maintain the confidentiality of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use or security breach
3.3 Geographic Availability
The Service is currently available for properties located in the United States, Canada, and Mexico only. We may expand to additional countries at our sole discretion. Users are responsible for ensuring their use of the Service complies with all applicable local laws and regulations in their jurisdiction. We reserve the right to restrict or terminate access from certain locations.
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Property Listings and Bookings
4.1 Property Ownership and Authorization
By listing a property on the Service, you represent and warrant that:
- You are either the legal owner of the property or have explicit written authorization from the legal owner(s) to list and share the property
- If you are not the sole owner, you have obtained consent from all co-owners, including but not limited to spouses, partners, co-tenants, or other parties with ownership interests
- Your use of the property for sharing complies with all applicable laws, regulations, and restrictions, including but not limited to:
- Local zoning ordinances and land use regulations
- Homeowners' association (HOA) bylaws, covenants, conditions, and restrictions (CC&Rs)
- Condominium association rules and regulations
- Lease agreements, rental agreements, or mortgage terms that may restrict subletting or sharing
- Short-term rental regulations and registration requirements
- Tax obligations and reporting requirements
- Building codes and occupancy limits
- You have the legal right to grant others access to the property for the purposes described
- There are no legal impediments, liens, or disputes that would prevent the lawful sharing of the property
Verification of Authority: Homier, LLC reserves the right to request documentation proving your ownership or authorization to list any property. Failure to provide such documentation upon request may result in immediate removal of the listing and termination of your account.
Ongoing Compliance: You acknowledge that compliance requirements may change and agree to maintain continuous compliance with all applicable laws and regulations throughout the time your property is listed on the Service.
4.2 Private Coordination Model
Homier operates on an invitation-only model for coordination between people who typically already know and trust each other. Properties are not publicly listed or searchable. Access is granted solely through direct invitations from property owners.
4.3 Booking Coordination and Payments
Our platform facilitates booking requests and calendar coordination between users. All actual agreements, terms of stay, and arrangements are handled directly between property owners and guests. Homier provides software tools only and is not responsible for the outcome of any stay or arrangement.
Payment Processing: Currently, Homier does not process payments between hosts and guests. Any financial transactions are handled directly between parties outside the Service. We may introduce optional payment processing services in the future, which would be subject to additional terms and conditions. You acknowledge that Homier is not responsible for any payment disputes between users.
5. Fees and Payment
5.1 Subscription Fees
Homier operates on a subscription model. Current pricing is available on our pricing page. We reserve the right to change prices with 30 days' notice sent to your registered email address.
5.2 Billing and Auto-Renewal
Subscriptions automatically renew at the end of each billing period unless cancelled. You authorize us to charge your payment method on a recurring basis. Renewal charges will be at the then-current subscription rate.
5.3 Cancellation and Refunds
You may cancel your subscription at any time through account settings. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial billing periods, except where required by law.
5.4 Payment Processing
We use third-party payment processors (such as Stripe) and do not store your payment card information. You agree to the payment processor's terms and conditions. Failed payments may result in service suspension.
5.5 Taxes
Subscription fees are exclusive of taxes. You are responsible for all applicable taxes, and we will charge tax when required by law.
6. Prohibited Uses and User Conduct
You are prohibited from using the Service for any unlawful purpose or in any way that violates these Terms. Specifically, you agree not to:
6.1 Illegal Activities
- Violate any applicable federal, state, local, or international law or regulation
- Use properties for illegal activities including but not limited to drug manufacturing, money laundering, or human trafficking
- Facilitate or engage in any form of illegal commerce or transactions
- Evade taxes or assist others in tax evasion
- Violate local zoning laws, homeowners' association rules, or rental restrictions
6.2 Commercial Misuse
- Operate commercial businesses from residential properties without proper permits
- Use the platform to compete with Homier or develop competing services
- Resell, redistribute, or commercially exploit the Service without authorization
- Use the Service for any purpose other than private family and friend coordination
- Convert private properties into unlicensed commercial accommodations
6.3 Platform Abuse
- Create multiple accounts or use false identity information
- Circumvent access controls, invitation systems, or security measures
- Interfere with, disrupt, or compromise the integrity of the Service
- Attempt to gain unauthorized access to any portion of the Service, other accounts, or computer systems
- Use automated systems, bots, scrapers, or scripts to access, collect, or harvest data from the Service
- Access the Service through any means other than the interfaces we provide
- Systematically retrieve data or content to create or compile a database without written permission
- Reverse engineer, decompile, or attempt to extract source code from the Service
6.4 Content and Communication Violations
- Post false, misleading, fraudulent, or deceptive content or information
- Upload content that infringes intellectual property rights of others
- Share content that is defamatory, threatening, harassing, or discriminatory
- Distribute malware, viruses, or other harmful computer code
- Post content that violates privacy rights or contains personal information of others without consent
- Use the platform to spam, solicit, or send unsolicited communications
6.5 Property-Specific Prohibitions
- List properties you do not own or have explicit legal authority to share
- List properties without consent from all co-owners or parties with ownership interests
- Violate any lease, rental agreement, mortgage terms, or deed restrictions
- Circumvent or violate HOA rules, CC&Rs, or condominium bylaws
- Misrepresent property conditions, amenities, availability, or location
- Use properties in ways that violate insurance policies or property agreements
- Allow use by individuals not covered by the property owner's invitation
- Exceed occupancy limits, safety regulations, or local noise ordinances
- Damage property or allow guests to cause damage through negligence
- List properties subject to foreclosure, legal disputes, or liens without disclosure
6.6 User Interaction Violations
- Harass, threaten, intimidate, or abuse other users
- Engage in discriminatory practices based on protected characteristics
- Attempt to collect personal information from other users for unauthorized purposes
- Impersonate other individuals or entities
- Interfere with other users' enjoyment of the Service
6.7 Financial and Security Violations
- Attempt to bypass or manipulate billing systems
- Use invalid, stolen, or fraudulent payment methods
- Share account credentials or allow unauthorized account access
- Attempt to compromise the security of user accounts or platform infrastructure
- Engage in any form of financial fraud or misrepresentation
7. Content and Intellectual Property
7.1 Your Content
You retain ownership of content you post to the Service. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your content solely for the purpose of operating and improving the Service. We will not use your property photos or content for marketing purposes without your explicit consent. You represent and warrant that you have all necessary rights to grant this license.
Content Restrictions: Other users may not reproduce, distribute, or use your content outside the Service without your permission. We respect your intellectual property rights and expect all users to do the same.
7.2 Our Content
The Service and its original content (excluding user content) are owned by Homier and are protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of the Service without our written permission.
7.3 DMCA Copyright Policy
We respect intellectual property rights and expect users to do the same. We will respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA).
Reporting Copyright Infringement: If you believe content on our Service infringes your copyright, please send a DMCA notice to our designated agent at: support_team@livehomier.com with the following information:
- Physical or electronic signature of the copyright owner or authorized representative
- Identification of the copyrighted work claimed to be infringed
- Identification of the allegedly infringing material and its location on the Service
- Your contact information (address, phone number, email)
- Statement that you have a good faith belief the use is unauthorized
- Statement under penalty of perjury that your notice is accurate and you are authorized to act
Repeat Infringer Policy: We will terminate accounts of users who are repeat infringers of intellectual property rights.
8. Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our collection and use of information as described in the Privacy Policy.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Homier provides software tools for coordination only. We specifically disclaim responsibility for:
- The conduct, identity, or background of any user
- Property conditions, safety, or accuracy of descriptions
- Compliance with local laws, tax obligations, or insurance requirements
- Any damages, injuries, or losses occurring during stays
- Disputes, agreements, or arrangements between users
- Any content, communications, or representations made by users
- The availability, reliability, or security of the platform
You acknowledge that private property sharing involves inherent risks and that you engage in such activities at your own risk.
10. Safety and Compliance Requirements
10.1 Property Owner Safety Obligations
Property owners are solely responsible for ensuring their properties meet all applicable safety standards and legal requirements, including:
- Maintaining functioning smoke and carbon monoxide detectors
- Ensuring electrical, plumbing, and structural safety
- Providing emergency contact information and evacuation procedures
- Disclosing any known hazards or safety concerns
- Maintaining appropriate property insurance coverage as required by local laws and regulations
- Complying with local fire safety and building codes
Insurance Requirement: Property owners must maintain appropriate insurance coverage as required by local laws and regulations for property sharing activities. Homier does not provide insurance, and owners are solely responsible for ensuring adequate coverage for their property and liability protection.
10.2 Guest Safety Responsibilities
Guests must:
- Follow all provided safety instructions and house rules
- Report safety concerns immediately to the property owner
- Use property and amenities responsibly and as intended
- Supervise any children or dependents at all times
- Refrain from activities that create safety risks to themselves or others
10.3 Legal Compliance
All users must ensure compliance with applicable laws including:
- Local zoning ordinances and short-term rental regulations
- Tax registration and reporting requirements
- Homeowners association rules and covenants
- Insurance policy terms and conditions
- Anti-discrimination and fair housing laws
- Accessibility requirements where applicable
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HOMIER, LLC, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.
IN NO EVENT SHALL THE AGGREGATE LIABILITY OF HOMIER, LLC FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE TOTAL AMOUNT PAID BY YOU TO HOMIER, LLC IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO SUCH LIABILITY.
12. User Responsibility and Indemnification
You are solely responsible for your use of the Service and compliance with all applicable laws. You agree to indemnify, defend, and hold harmless Homier, LLC, its officers, directors, members, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, fees (including reasonable attorneys' fees), and legal fees arising from or relating to:
- Your use of the Service or violation of these Terms
- Your property listing, sharing activities, or stays
- Any misrepresentation regarding property ownership or authorization to list
- Any violation of local laws, zoning ordinances, HOA rules, or other property use restrictions
- Any agreements or disputes between you and other users
- Your violation of any law, regulation, or third-party rights
- Any content you post or transmit through the Service
- Any property damage, personal injury, or other harm related to your use of the platform
- Any failure to meet safety, compliance, or legal requirements outlined in Section 10
- Any claims related to prohibited uses outlined in Section 6
- Any claims by property owners, co-owners, landlords, HOAs, or governmental authorities regarding unauthorized use of property
13. Enforcement and Violations
13.1 Investigation Rights
We respect user privacy and do not proactively monitor private communications or content. However, we reserve the right to investigate specific situations when:
- We receive reports of potential violations
- Required by law or legal process
- Necessary to protect safety or prevent harm
- Needed to enforce these Terms or protect our rights
Any investigation will be limited to what is necessary and proportionate to address the specific concern.
13.2 Reporting Violations
Users may report violations of these Terms or suspicious activity by contacting us at support_team@livehomier.com. We will review reports and take appropriate action at our sole discretion.
14. Account Suspension and Termination
14.1 Termination for Cause
We may immediately terminate or suspend your account for material violations including:
- Illegal activities or criminal behavior
- Threats to safety or security of users or the platform
- Fraudulent activity or payment violations
- Serious violations of prohibited uses (Section 6)
- Attempts to compromise platform security
14.2 Termination with Notice
For non-critical violations, we will provide warning and opportunity to remedy before termination. We may terminate accounts with 30 days' notice for convenience or business reasons.
14.3 Account Suspension
We may suspend accounts temporarily during investigations. Suspended users retain the right to export their data and will be notified of suspension reasons and expected duration when possible.
14.4 User-Initiated Termination
You may terminate your account at any time through account settings. Upon request, we will provide your data in a portable format within 30 days. You remain responsible for obligations incurred before termination.
14.5 Effect of Termination
Upon termination:
- Access to the Service ceases (immediately for cause, after notice period otherwise)
- You have 30 days to request data export before deletion
- Outstanding payment obligations remain due
- Legal provisions (liability, indemnification, disputes) survive termination
- Reactivation requires our approval for accounts terminated for cause
15. Dispute Resolution
15.1 Arbitration
Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules. The arbitration shall be conducted in Seattle, Washington, unless both parties agree to a different location. The arbitrator's decision shall be final and binding, and judgment may be entered upon it in any court of competent jurisdiction.
15.2 Class Action Waiver
YOU AND HOMIER, LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
16. Force Majeure
Neither party shall be liable for any failure or delay in performance under these Terms due to circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, epidemic, pandemic, government actions, labor disputes, or failures of third-party services. This provision does not excuse payment obligations.
17. General Terms
17.1 Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal action or proceeding relating to your access to or use of the Service shall be instituted exclusively in the state or federal courts located in King County, Washington. You agree to submit to the personal jurisdiction of such courts and waive any objection to the exercise of jurisdiction over you by such courts and to venue in such courts.
17.2 Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the modified Terms.
17.3 Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices published by Homier, LLC on the Service, constitute the entire agreement between you and Homier, LLC concerning the Service and supersede all prior agreements and understandings.
17.4 Severability
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
17.5 Waiver
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition, and Homier, LLC's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
17.6 Assignment
You may not assign or transfer these Terms, by operation of law or otherwise, without Homier, LLC's prior written consent. Any attempt by you to assign or transfer these Terms without such consent shall be null and void. Homier, LLC may freely assign or transfer these Terms without restriction.
